Unveiled in 2013 by president Xi Jinping, the Belt and Road Initiative (BRI) is a transcontinental long-term policy and investment program that aims to increase infrastructure development and economic integration for countries in the region. Increases in investment go hand in hand with a spike in commercial disputes, which then require well-functioning and legally sound dispute settlement mechanisms to assist contracting parties when faced with complex commercial disputes. To assist therein, BRI countries are encouraged to enhance their understanding of each other’s legal and judicial systems and to facilitate cross-border international enforcement of court judgments and arbitral awards. In recent years, there is also the emerging practice of promoting particular jurisdictions and even particular commercial courts to provide one-stop shop dispute resolution services.

This EUPLANT panel aims to discuss the promotion of particular legal hubs for BRI related litigation, including the recently established Chinese commercial courts. In addition, the panel will also touch upon whether there remains a role envisioned for Hong Kong to constitute a one-stop shop for cross-border commercial dispute resolution for BRI matters.
